Applies To: Clark Hospitality Group, LLC dba Spa Luxe and C3 Spa Hospitality Group, LLC dba Spa Luxe Austin (collectively, “Spa Luxe,” “we,” “us,” or “our”)
  1. PURPOSE AND SCOPE
    This Privacy Policy and HIPAA Notice of Privacy Practices (“Notice”) explains how Spa Luxe collects, uses, discloses, and protects your personal information and Protected Health Information (“PHI”) in our locations, websites, and online platforms. By using our services or completing intake forms, you agree to this Notice.
  2. OUR COMMITMENT TO PRIVACY
    We protect the confidentiality, integrity, and security of your information in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Texas Medical Privacy Act, and other applicable laws. We maintain administrative, technical, and physical safeguards to protect your information.
  3. INFORMATION WE COLLECT
    Personal Information You Provide: Name, date of birth, address, email, phone, payment and billing details, service history and preferences, and health or treatment information relevant to your care such as medical history, medications, allergies, pregnancy status, or prior procedures.
    Automatically Collected Information: IP address, device and browser type, operating system, pages viewed, session activity, cookies, pixels, and similar technologies.
    Information From Third Parties: Limited information from referral sources, marketing platforms, public databases, or service partners to verify identity, personalize services, or comply with law.
  4. HOW WE USE YOUR INFORMATION
    Treatment, Payment, and Health Care Operations: To provide, coordinate, and manage spa and medical spa services; process payments and billing; verify benefits; conduct training and audits; and maintain required records.
    Transactional/Operational: To confirm appointments, orders, and service reminders, and handle customer service or returns.
    Marketing/Promotional (with consent): To send email or text updates, offers, or event invitations, and personalize your experience. You may opt out at any time (see Section 11).
    Legal/Safety: To comply with legal obligations or prevent serious threats to health or safety.
  5. WHEN WE SHARE INFORMATION
    We do not sell your personal information. We may share information only as needed with business associates and service providers (such as scheduling, payment, data hosting, analytics, or email/text vendors) under HIPAA-compliant agreements; affiliates within the Spa Luxe brand family; or regulatory and legal entities as required by law.
  6. YOUR HIPAA RIGHTS
    You have the right to access or request copies of your records, request corrections, request restrictions on use or disclosure, request confidential communication by alternate means, request a list of certain disclosures, and obtain a paper copy of this Notice at any time. Requests must be submitted in writing to the Privacy Officer (see Section 13). We will respond as required by law.
  7. DATA SECURITY AND RETENTION
    We use encryption, access controls, staff training, and secure systems to protect your data. We retain records only as long as required by law or for legitimate business purposes, and then dispose of them securely.
  8. MOBILE (SMS/TEXT) TERMS
    By opting in, you agree to receive recurring text messages about appointments, updates, and promotions. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or email marketing@spaluxe.com

  9. COOKIES AND ANALYTICS
    We use cookies and analytics tools such as Google Analytics to operate, improve, and measure website performance. Cookies do not store sensitive data. You may disable cookies in your browser, but some features may not work properly.
  10. THIRD-PARTY LINKS AND SOCIAL MEDIA
    Our websites and pages may link to third-party websites or social media platforms. Their privacy policies apply to their services. Spa Luxe is not responsible for their privacy practices.
  11. YOUR COMMUNICATION CHOICES
    You may opt out of marketing emails or texts using the unsubscribe link or by contacting info@spaluxe.com
    . We may still send necessary operational messages such as appointment confirmations, billing notices, or care instructions.
  12. CHILDREN’S PRIVACY
    We do not knowingly collect information from anyone under 18 years of age without parent or guardian consent. If you believe such information has been provided in error, contact us to remove it.
